Terms & Conditions

 

THE PRICE INCLUDES:

  • Maldivian T-GST 16% and Maldivian “Green Tax”;
  • 3 daily dives for a total of 16/18 dives for 7-nights trip, 22/24 dives for the 9-nights trip, 25/27 for the 10-nights trip, 31/33 dives for the 12-nights trip, except check-in day and the last 24 hours NO-FLY before departure flight PLEASE NOTE: if the customers purchases the return flight departing within the morning of the check-out day, they will only be able to do one or two of the dives scheduled the day before. To take advantage of the entire diving package offered, we suggest purchasing the return flight in the afternoon of the day of the check-out. 
  • 1 night dive included during the 7-nights and 9-nights trip – 2 night dives included during the 10-nights and 12-nights trip. The night dive will be considered as the third dive of the day included in your package. 
  • Diving Dhoni and Dinghy for diving and snorkeling activities: 13lt aluminum tanks, belt and weight;
  • Full Board: Breakfast, Lunch and Dinner in buffet style, and some snacks during the day;
  • Drinking water, Nescafe & tea;
  • Transport from and to the airport on arrival and departure scheduled cruise dates;
  • Fishing from the boat (where allowed);
  • Trips to local islands, private islands and sandbanks: it could be requested a small entrance fee;
  • Trip to Male’ (if allowed and safe) available for “Best of Central Atolls”, “Manta Madness” and “Northern Highlight” itineraries only;
  • Daily snorkeling;
  • 1 barbeque dinner on the beach, if weather conditions permit;
  • All extra activities the crew is able to offer based on the preferences of the group onboard: biology lessons, talks about the Maldives, clean-ups on the beach, clams gathering, karaoke night, disco night, and so on!

    THE PRICE DOES NOT INCLUDE:

  • “SERVICE FEE”: 130 USD/PERSON per 7 nights trip, 165 USD/PERSON per 9 nights trip, 185 USD/PERSON per 10 nights trip, 220 USD/PERSON per 12 nights trip. This amount needs to  be paid CASH in US DOLLAR onboard before departure.
  • Flight ticket (International flight to/from MLE or to/from GAN or Domestic Flights to/from Gan for the itineraries: “10 Atolls, 2 Hemispheres” and “Wild Deep South”);
  • Insurances: travel, medical, Pandemics/Covid-19 – we strongly recommend customers to arrive in the Maldives with a valid insurance, in order to avoid possible unpleasant loss of money in case of booking cancellation, according to “booking and reservations” and “cancellation policy”;
  • Diving Insurance (MANDATORY, for all divers): DAN temporary insurance can be stipulated directly onboard (prices on request);
  • Soft Drinks and alcoholic beverages (prices on request);
  • NITROX usage: SACHIKA: 70 USD x 7 night trip, 80 USD x 9 night trip, 90 USD x 10 night trip and 100 USD x 12 night trip; PRINCESS MAANI: NITROX FREE OF CHARGE;
  •  
  • Equipment rental: Bcd, Regulator, Mask, Fins, Snorkel, Wetsuit, Diving Computer and 15lt steel tank or additional stages (11 lt tanks) AVAILABLE for rent onboard – we suggest to book the necessary equipment in advance; 
  •  Diving courses (price list on request);
  • Extra dives (when possible, an extra fourth dive will be planned by cruise manager);
  • National/Marine Park fees, where required: until August 2024 required only in Baa Atoll – “Manta Madness” and “Northern Highlight” Itineraries;
  • Wi-Fi internet access: 30 USD/PERSON per 7 nights trip, 35 USD/PERSON per 9 nights trip, 38 USD/PERSON per 10 nights trip, 45 USD/PERSON per 12 nights trip.;
  • Transport from and to the airport in date out of the calendar beginning/end of the cruise;
  • Everything not described in “The price includes”.

 

IMPORTANT NOTICE

  • Check-in time on board on  arrival day (from MLE or GAN airport) possible starting from 11:00 to 24:00;
  • Check-out time on departure day (to MLE or GAN airport)required within 7:30 am;
  • All the payments on board are possible in cash US$, cash EUR or by Credit Cards (we accept MasterCard and VISA, with a commission of 4%).

CONDITIONS OF THE AGREEMENT

BOOKING and RESERVATIONS

  1. 30% of the total invoice is required at the moment of the confirmation of the cruise to confirm the spot. Such deposit is REFUNDABLE if the booking is canceled before 120 days (4 months) prior to the scheduled departure. The 30% DEPOSIT BECOMES NOT REFUNDABLE if the booking is canceled less than 120 days before departure. Once the Guests pay the deposit they accept Top Class Cruising’s Terms and Conditions.
  2. Balance amount 45 days prior to the beginning of the cruise. If the balance is not paid within 45 days from the departure, Top Class Cruising reserves the right to cancel the booking, withholding any payment already received. The booking will be automatically canceled after 48 hours from the balance payment reminder if the customer does not respond or doesn’t pay.

CANCELLATION POLICY

Cancellations need to be made in writing to booking @ topclasscruising.com and the customer shall receive a CONFIRMATION within 48 hours. NOTE: Top Class Cruising is a stable and flexible company: every case will be analyzed based on its specifications and the company will always try to move towards the interest of any Guest and Tour Operator.

    • CANCELLATION BY THE GUEST

      • If the Guests cancel the trip MORE THAN THIRTY DAYS UNTIL 120 DAYS before the booked departure, Top Class Cruising shall reimburse any BALANCE (70% of the TOTAL) already paid within thirty (30) days from the cancellation but reserves the right to deduct all related bank charges from the refund.
      • If the Guests cancel the trip between ZERO and THIRTY DAYS before the booked departure date, Top Class Cruising reserves the right to keep the total amount paid by the Guests (30% DEPOSIT + 70% BALANCE).
      • For any cancellation within or prior 30 days from departure, Top Class Cruising will try to sell the canceled spots. In case the company succeeds in such a goal, the company will offer the opportunity to the canceling Guests to postpone their trip to future dates. In this case, Top Class Cruising reserves the right to adjust the rates of the new booking.
    • CANCELLATION BY TOP CLASS CRUISING

      • Top Class Cruising shall not be held responsible for any expenses incurred by the Guest in preparation or related to the booked tour, including but not limited to non-refundable airline tickets or cancellation fees, any costs of transportation, accommodation, meals, special clothing, or equipment, visa, passport fees, etc.

  • Top Class Cruising doesn’t practice overbooking. In the event that a Guest cannot be accommodated onboard due to circumstances, which are directly related to Top Class Cruising, such as technical problems with the vessel, or any other, Top Class Cruising shall accommodate the Guest in another adequate establishment at no additional expense to the Guest.

  • BOOKING AMENDMENTS: Booking amendments by either Party need to be done in writing via email. The receiving Party shall confirm the reception of this email within forty-eight (48) hours. It is at the discretion of Top Class Cruising to accept or deny amendments requested by the Guest.

  • Early departures and late arrivals. In the event of a Guest’s early departure or late arrival to or from an ongoing cruise, Top Class Cruising shall assist the Guest in organizing a transfer to/from Male’ or the nearest airport or another designated location in the Maldives. Top Class Cruising cannot guarantee this will be organized. All third-party charges are at the Guest’s expense and Top Class Cruising reserves the right to charge a handling fee. If the transfer is conducted with a Top Class Cruising vessel, the Company shall charge a return transfer fee to the Guest.

  • Cabin category change. Changes to cabin category are possible if done at least 30 days before departure but obviously subject to availability. In case the change of cabin is from a higher to a lower category the rate difference shall be refunded in the form of a balance/credit to be used onboard or otherwise. In case the change of cabin is from a lower to a higher category, the difference in rate between those two shall be paid.

  • Other amendments. Top Class Cruising reserves the right, at any time and without prior notice, to substitute the cruise vessel if circumstances require such changes and/or if deemed necessary and appropriate. Reasons such as government instability, civil riots, Pandemic and force majeure are deemed as reasons beyond the control of the Company: in such cases Top Class Cruising might cancel the trip with no prior notice. The Company will offer the Guests the opportunity to change the dates of the trip to safer times. Top Class Cruising shall not be liable for refunds or compensation in any shape or form.

  • RESCHEDULING: Rescheduling is the change of dates of an existing booking without the need to cancel the booking. All reschedules are subject to availability in occupancy, cabin category, and package inclusions. The rescheduled booking may be subject to charges amounting to the variation of rates between relocation dates. The charges for rescheduling are as follows: (a) No changes for rescheduling requests concerning individual bookings asked 45 days before departure; (b) For rescheduling requests received 0 to 45 days before departure, a flat charge of $250.00 USD applies. No flat charge will be applied if the Company manages to sell the released spots after the booking has been rescheduled.

  • NO SHOW AND EARLY DEPARTURE: NO REFUNDS  –> 100% of the invoice will be kept by Top Class Cruising.

FULL CHARTER SECTION

    1. The FULL CHARTER DATES on the requested vessel can be held by Top Class Cruising until 4 months (120 days) before scheduled departure;
    2. Four months before the scheduled departure, the FULL CHARTER MUST BE CONFIRMED, released or transformed into a group booking (see the below section: GROUP BOOKINGS and DISCOUNTS). In this occasion, at least the 30% of the total amount (NON-REFUNDABLE) has to be transferred to Top Class Cruising, in order to keep the cabins on hold;
    3. PAYMENT PLAN HAVE TO BE DISCUSSED BETWEEN TOP CLASS CRUISING AND THE TRIP ORGANIZER. Top Class Cruising is flexible to accept payments in more than 2 steps, to make the organization smoother. The deadlines for the DEPOSITS and the BALANCE will be set as soon as possible and respected in order to hold the boat for the interested client;
    4. The BALANCE PAYMENT has to be transferred to Top Class Cruising 45 days before departure, unless both parties agreed differently.
  • 30 days before departure all details of the guests (flight details, names, passport numbers, special requests) must be shared with Top Class Cruising.

IMPORTANT NOTICE: in case the FULL CHARTER is not met, individual NET PRICES WILL BE CHARGED for the NUMBER OF PEOPLE and the TYPE OF CABIN.


GROUP BOOKINGS AND DISCOUNTS

  • Third person in the same cabin: Adult / teenager: -20%; 
  • Third person in the same cabin: Child (under 12 y.o.): -50%
  • 9 PEOPLE PAY + 1 FREE OF CHARGE
  • 14 PEOPLE PAY + 2 FREE OF CHARGE


EXTRA PAYMENTS

  • SINGLE USE SURCHARGE: +60%;
    • EXTRA SUPPLY REQUIRED in case of expenses that exceed the estimated budget (i.e. extra fruit, extra sashimi, extra banana branch or any other special request);
  • FUEL ADJUSTMENTS;
  • PRIVATE GUIDE: 700,00 USD from December to April, 500,00 USD for the rest of the season.

GENERAL PROCEDURES AND “COMMON SENSE”

BEFORE THE CRUISE: All Guests traveling with Top Class Cruising in the Maldives should possess a passport with 6 months validity from the returning day to the country of origin. 

Before departure, the customers undertake to fill up and submit all the documents required by the Company and the Maldivian Immigration Ministry within the time limits. Top Class Cruising requires the Guests to fill up an online form divided into two parts: RELEASE OF LIABILITY and MEDICAL STATEMENT. Diving licenses (agency and numbers) are required when filling up the forms and can be asked by the boat manager/dive guides at any time during the trip. If the medical statement is not cleared, a medical certificate is required prior to starting any water activity. The suspension of any diving activity could be asked to the Guests, if the Guests’ state of fitness is considered to be a danger for themselves or others. 

BEHAVIOURAL CONDUCT: Anti-social, racial, homophobic or aggressive behaviour will NOT BE TOLERATED and individuals who cause a disturbance to other Guests may be removed from the liveaboard with the help of local authorities, if necessary. 

ITINERARIES AND ROUTES: All itineraries, dive spots, diving and other activities could be subject to various unpredictable changes due to weather conditions and other casualties. In adverse weather conditions the guides and the Captains of the boat and the dhoni, will have the final decision about which dive sites to visit to ensure that the Guests, staff and boats safety is not compromised in any way. In the unfortunate event that dives are missed or dive sites are not reached due to weather conditions or other unforeseeable changes, Top Class Cruising will not offer any refund or compensation. The 4th dive of the day, when scheduled, is always considered an EXTRA and needs to be paid as such. Top Class Cruising cares about the human rights of their employees: overtime must be recognized and reinforced to the Dive guides and the Dhoni Crew.

DIVING PROCEDURES AND SAFETY UNDERWATER: All the dives with Top Class Cruising are guided by professionals experienced Dive Guides and/or Diving Instructors. There will be no dives where the Guests are going to dive without the presence of the Dive Guides. If the Guest didn’t have the chance to dive for longer than six months, Top Class Cruising suggests making a Scuba Review on the first day of diving. Top Class Cruising advises all the divers to complete the check dive prior to starting all diving activities. The Company reserves the right to restrict diving activities if the instructor has any concerns regarding divers safety. Please, accept any decision of the Captain and the Dive Guides and remember that our customer’s safety is our priority No. 1. 

UNPREDICTABLE EVENTS: It is a condition of your contract with Top Class Cruising to issue a Diving Insurance (possible onboard) that covers the diver during the whole duration of the trip. Top Class Cruising will not be held responsible for any financial loss incurred by issues beyond our control such as, but not limited to weather, ‘Act of God’ or changes made by the local authorities.

The Guests are deemed responsible, but not obliged, to purchase a Travel Insurance that covers:

  1. Dive Injury Insurance: covering all risks, costs and expenses likely to be incurred as a result of a diving injury, including but not limited to re-compression chamber treats, air evacuation, and loss or damage to possessions. This insurance should cover all scuba diving or water sports activities that you are likely to undertake during your trip;
  2. Medical Evacuation Insurance: covering all risks, costs and expenses likely to arise from a diving or non-diving injury requiring your evacuation to a place of specialist care;
  3. Comprehensive Travel Insurance: to cover any pre-departure cancellations should you have to cancel your trip for an insured reason such as illness or serious accident, any changes or cancellation to your travel plans, loss or damage to your luggage and contents.

If you choose to travel without adequate insurance cover, Top Class Cruising will not be liable for any losses however arising, in respect of which insurance cover would otherwise have been available.
