The penalty is not applied in the rare case TCC/FCC is able to re-sell the original released cabin.
FULL CHARTER AND GROUP BOOKING SECTION
1. Date holding & Mandatory Confirmation
The FULL CHARTER/GROUP BOOKING DATES on the requested vessel can be held by TCC/FCC until 6 months before scheduled departure ONLY PRIOR TO THE PAYMENT OF AN AGREED DEPOSIT, which varies between 15% and 30% of the TOTAL AMOUNT.
Six months before the scheduled departure, the FULL CHARTER MUST BE CONFIRMED, released, or transformed into a group booking (see the above section: GROUP BOOKINGS and DISCOUNTS). In this state of the booking, if any cabins are released, the deposit will be used as a part of the payment of the revised invoice. This deadline is strict and automatically enforced. Failure to provide written confirmation and the corresponding payment by this date will result in the immediate and automatic release of all held cabins.
2. Payment Terms & Schedule
Upon confirmation at the 6-month deadline, a second non-refundable deposit UP TO 50% of the total charter amount is immediately due.
The Full Charter payment schedule is binding and structured as follows to secure the booking:
- First Deposit, BETWEEN 15% AND 30% OF THE TOTAL AMOUNT: Due upon confirmation and refundable if the Full Charter is canceled (6 MONTHS PRIOR DEPARTURE) or USED TO COVER REVISED INVOICE, IN CASE OF RELEASE OF SOME CABINS.
- Second Deposit, UP TO 50% OF THE TOTAL AMOUNT: Due 180 days (approximately 6 months) before scheduled departure. With confirmation of the Full Charter 6 months before departure, both deposits totaling 50% will become NON-REFUNDABLE.
- 50% Final Balance: Due 45 days before scheduled departure.
Any deviation from this standard payment plan must be explicitly agreed in writing by TCC/FCC management before the confirmation deadline.
3. Full Charter Cancellation Policy
Specific cancellation penalties apply to Full Charter bookings and override the standard individual booking terms. Cancellation by the Organizer will incur the following penalties on the total charter amount:
- Cancellation from confirmation until 180 days before departure: No penalty (No loss of the 1st deposit) and Full Refund of the first deposit or revaluation of the amount for group reservations. TCC/FCC reserves the right to deduct all related bank charges from the refund;
- Cancellation from 180 days until 45 days before departure: 50% penalty (loss of both 1st and 2nd deposits);
- Cancellation less than 45 days before departure: 100% penalty. Non-payment of any installment by its due date will be considered a de facto cancellation by the Organizer, and the corresponding penalties will be applied automatically.
TCC/FCC shall not be held liable for any delay or failure to perform its obligations if such delay or failure in providing the service is caused by an event or circumstance beyond its reasonable control. It is highly suggested to any Individual Guest, Group Organiser, Agent or Tour Operator to purchase a TRAVEL INSURANCE that includes refunds in case of FORCE MAJEUR or most of the above mentioned circumstances. This includes, but is not limited to: Acts of God (e.g., natural disasters, severe weather), war, hostilities, or civil unrest, terrorist attacks, pandemics, epidemics, or any public health crisis, government restrictions, travel bans, or port closures, flight cancellations due to the above reasons in Maldives or any of the connecting hubs.
4. Organizer’s Sole Responsibility
The Tour Operator/Group Organiser is the sole contractor towards TCC/FCC and bears full financial responsibility for the entire charter cost, irrespective of their ability to fill all cabins with final clients. TCC/FCC’s business relationship is exclusively with the Organizer.
5. Rights of TCC/FCC upon Non-Payment
If the deposits and full balance are not received by the deadline on the invoice, TCC/FCC reserves the right to:
- Retain all payments made as a cancellation penalty.
- Refuse embarkation to all clients of the Organizer.
- Re-sell any and all cabins.This action is without prejudice to TCC/FCC’s right to receive full payment, and the Organizer remains liable for the total outstanding amount.
6. Post-Cancellation Cabin Sales and Credit
In the event of a cancellation, the release of any unsold cabins may allow TCC/FCC to resell them through all conventional channels. Upon management’s approval, the proceeds from such resales may be held as a credit for the Organizer, applicable towards a future booking.The amounts may also be reimbursed directly. TCC/FCC reserves the right to deduct all related bank charges from the refund;
7. Guest Details & Administration
The BALANCE PAYMENT has to be transferred to TCC/FCC 45 days before departure, unless a different written agreement is in place. 30 days before departure, all details of the guests (flight details, names, passport numbers, special requests) must be shared with TCC/FCC and the ARRIVAL FORM must be filled by each guest.
IMPORTANT NOTICE FOR GROUP/FULL CHARTER ORGANISERS
- In case the FULL CHARTER is not met, INDIVIDUAL NET RATES WILL BE CHARGED for the number of guests and the type of cabins confirmed.
- CRUISE PAYMENT: in case of a FULL CHARTER or a big group (more than 10 pax) it is required to pay for the cruise by BANK TRANSFER. The payment for group bookings has to be done for a maximum of 3 DEPOSITS and 3 BALANCE PAYMENTS, in order to reduce the amount of BANK COMMISSION for both parties.
- In case a Tour Operator/Group Organiser prefers to pay by ONLINE LINK, the bank charges of 4% will be added to the NET AMOUNT.
GENERAL PROCEDURES AND “COMMON SENSE”
BEFORE THE CRUISE: All Guests traveling with TCC/FCC in the Maldives should possess a passport with 6 months validity from the returning day to the country of origin. Before departure, the customers undertake to fill up and submit all the documents required by the Company and the Maldivian Immigration Ministry within the time limits. TCC/FCC require the Guests to fill up an online form divided into two parts: RELEASE OF LIABILITY and MEDICAL STATEMENT. Diving licenses (agency and numbers) are required when filling up the forms and can be asked by the boat manager/dive guides at any time during the trip. If the medical statement is not cleared, a medical certificate is required prior to starting any water activity. Top Class Cruising and First Class Cruising are not liable for any medical expenses incurred during the trip. The suspension of any diving activity could be asked to the Guests, if the Guests’ state of fitness is considered to be a danger for themselves or others. The consumption of alcohol is allowed within reasonable limits. Illegal drugs are strictly prohibited. Violation of this policy will result in immediate disembarkation without a refund.
BEHAVIOURAL CONDUCT: Anti-social, racial, homophobic or aggressive behavior will not be tolerated. Individuals who cause a disturbance to other Guests or to our valuable Crew may be removed from the liveaboard with the help of local authorities, if necessary. Safety Briefing: All guests will receive a mandatory safety briefing upon boarding and are required to follow crew instructions at all times. Top Class Cruising and First Class Cruising are not responsible for lost, stolen, or damaged personal items, including diving equipment, during the trip.
ITINERARIES AND ROUTES: All itineraries, dive spots, diving and other activities could be subject to various unpredictable changes due to weather conditions and other casualties. In adverse weather conditions the Cruise Director with the Captains of the boat and the dhoni, will have the final decision about which dive sites to visit to ensure that the Guests, staff and boats safety is not compromised in any way. In the unfortunate event that dives are missed or dive sites are not reached due to weather conditions or other unforeseeable changes, TCC/FCC will not offer any refund or compensation.
FAIR LABOR PRACTICES: The 4th dive of the day, when scheduled, is always considered an EXTRA and needs to be paid as such. TCC/FCC cares about the human rights of their employees: overtime must be recognized and reinforced to the Dive guides and the Dhoni Crew. The chance to make an extra dive has to be considered as such: a chance! Guests are free to participate by paying the required cost or skip the activity.
DIVING PROCEDURES AND SAFETY UNDERWATER: All the dives with TCC/FCC are guided by professionals experienced Dive Guides and/or Diving Instructors. There will be no dives where the Guests are going to dive without the presence of the Dive Guides. A Scuba Review is suggested for Guests who didn’t have the chance to dive for longer than six months. TCC/FCC advises all the divers to complete the check dive prior to starting all diving activities. The Company reserves the right to restrict diving activities if the instructor has any concerns regarding divers safety. Please, remember that our customer’s safety is our priority No. 1. A minimum number of 5 logged dives and an OWD license is required to dive since the beginning of the trip. If the guest would like to overcome the limits of the OWD license, a specific training needs to be taken onboard with a TCC/FCC Diving Instructor, at additional costs, for safety reasons concerning underwater navigation, deep and current dives.
UNPREDICTABLE EVENTS: TCC/FCC will not be held responsible for any financial loss incurred by issues beyond our control such as, but not limited to weather, ‘Act of God’ or changes made by the local authorities. If you bring valuable objects or large sums of money with you, do not hesitate to ask the cruise director about the possibility of leaving these items inside the boat safe (if there is no safe in your cabin). The company will not be held responsible for any loss or suspected theft on board.
It is a condition of your contract with TCC/FCC to issue a DIVING INSURANCE (possible onboard) that covers the diver during the whole duration of the trip.
The Guests are deemed responsible, but not obliged, to purchase a Travel Insurance that covers:
a. Medical Evacuation Insurance: covering all risks, costs and expenses likely to arise from a diving or non-diving injury requiring your evacuation to a place of specialist care;
b. Comprehensive Travel Insurance: to cover any pre-departure cancellations should you have to cancel your trip for an insured reason such as illness or serious accident, any changes or cancellations to your travel plans, loss or damage to your luggage and contents.
IMAGE AND MEDIA RIGHTS: Top Class Cruising and First Class Cruising reserve the right to use photos and videos taken during the trip for promotional purposes. Guests who do not wish to appear in such media should inform the crew before departure, during the completion of the mandatory Arrival Form and/or when onboard. If you choose to travel without adequate insurance cover, Top Class Cruising and First Class Cruising will not be liable for any losses however arising, in respect of which insurance cover would otherwise have been available.
COMPLAINTS & FEEDBACKS: Reporting Complaints: Guests are encouraged to bring any complaints to the attention of the crew during the trip so that they can be resolved promptly.
Post-Trip Feedback: After your cruise, you will receive a Survey. Please, let us know what are your feelings about the cruise. Complaints can also be addressed to the email address booking@topclasscruising.com.
JURISDICTION AND GOVERNING LAW:
- Applicable Law: These Terms & Conditions are governed by the laws of the Maldives. Any disputes arising from this agreement will be subject to the jurisdiction of the courts in the Maldives.
- Dispute Resolution: Before pursuing legal action, both parties agree to attempt to resolve any disputes through mediation or arbitration
